Federal Judge Says Michigan Gyms Can Open June 25th

State Presented "Insufficient" Rationale for Keeping Gyms Closed

On Friday, U.S. District Judge Paul Maloney opined that indoor gyms in Michigan be allowed to open on June 25th, ruling in favor of League of Independent Fitness Facilities and Trainers Inc., alongside nearly two dozen other gym operators.  

Maloney issued a preliminary injunction opposing the Governor's Executive Order 2020-110, which extended gym closures for portions of the state which have not moved to Phase 5 of the Governor's six-phase MI SAFE START state reengagement plan.  

Only the Upper Peninsula and the Traverse City area are currently in Phase 5.  The remainder of the state remains in Phase 4.  Governor Whitmer said earlier this week that she hoped to move the rest of the state to Phase 5 by the July 4th holiday.

Complainants argued that the ban on fitness centers violated rights to due process, equal protection and commerce law.

Maloney wrote "Faced with imminent harm, plaintiffs presented defendants with a simple question: why must we remain closed? Defendants answered with a blanket 'trust us' statement that is insufficient to uphold a no-longer-blanket rule."

On Wednesday, Governor Whitmer extended the State of Emergency declaration.  She plans to appeal Judge Maloney's decision.
